"Services" refer to our AI Voice Agents, call automation tools, and website.
By accessing our website, signing up, or using our services, you confirm that you have read, understood, and accepted these Terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use our services.
Subscriptions are billed automatically unless canceled. Payments are non-refundable unless required by law.
Refunds are generally not provided, except in cases where required by law or if a service was not delivered as promised. If you believe you are eligible for a refund, contact contact@vivaspeak.com.
We collect personal data as outlined in our Privacy Policy.
All software, trademarks, and content belong to VivaSpeak. You may not copy or distribute them.
We strive to provide 24/7 uptime but do not guarantee uninterrupted service. VivaSpeak is not liable for outages due to maintenance, third-party service failures, or unforeseen circumstances.
We may terminate accounts for violations or unpaid fees. Refunds are not issued for terminations due to breaches.
We are not responsible for indirect, incidental, or consequential damages. Our maximum liability is limited to the last three months' payments.
EU consumers have a right to withdraw within 14 days of subscription unless the service has been used.
VivaSpeak reserves the right to update or modify these Terms at any time. If changes are significant, we will notify users via email or through a notice on our website. Your continued use of the Services constitutes acceptance of the updated Terms.
For EU users, disputes are subject to Spanish law and resolved in Barcelona, Spain.
Before initiating legal action, both parties agree to attempt resolution through mediation. If mediation fails, disputes shall be resolved via arbitration in Barcelona, Spain.
